1. Name and Contact Data of Data Controller and Data Protection Officer

The present Data Protection Notes apply to:

2. Data Protection Officer

As the sole proprietor, I am not legally required to appoint a data protection officer. I nevertheless choose to comply with the provisions of the Data Protection Act.

 
3. Collection and Storage of Personal Data; Type, Purpose and Use

In the event of an order, the following data will be collected:

  • Gender, title, first name, surname
  • Address
  • Email address
  • Poss. telephone number (fixed line and/or mobile)

Any data required to fill an order or perform a contract with you will also be recorded.

The collection of personal data is required in order to:

  • identify you as a customer
  • provide adequate counselling
  • meet my contractual obligations to you
  • meet my legal obligations
  • enter into correspondence with you
  • issue invoices and dunning notices if necessary
  • assert possible claims against you.

The processing of personal data is made at the occasion of your enquiry and is required to process your enquiry for the above purposes and for the performance of obligations resulting from the underlying contract or order.

Collected personal data are retained up to the of the legally imposed storage period (6, 8 or 10 years after the end of the calendar year in which the contractual relationship was terminated) and are then deleted. Exceptionally, this does not apply to a longer storage period imposed under the provisions of the tax or commercial laws or if you have agreed to a storage period beyond the above.

 

4. Data Transmissions to Third Parties

In principle, your personal data are not transmitted to third parties except when this is required for the performance of the contract or your order. If your personal data are to be transmitted to a (potential) customer or service provider outside the EU or the European Economic Area (EEA), transmission takes place only with your consent. This includes in particular the transmission to subcontracted service providers (data processors) or other third parties whose cooperation is required for contract performance. Data transmitted may be processed by the third party exclusively for the above-mentioned purposes.

 

5. Your Rights as a Data Subject

As the Data Subject whose data are being processed, you are entitled to a variety of rights:

  • Right to revocation: You may revoke a consent granted to us at any time. Data processing associated with a revoked consent may then no longer be carried out in the future.
  • Right to information: You may demand information on your personal data processed by us. This applies in particular to the processing purpose, the category of personal data, possibly to the category of recipient, the storage period and the origin of your data.
  • Right to correction: You may demand the correction or completion of your personal data stored with us.
  • Right to deletion: You may demand the deletion of your personal data stored with us provided that their processing is not required to exercise the right to free expression and information, to meet a legal obligation, for reasons of public interest or to assert, exercise or defend a legal claim.
  • Right to the restriction of processing: You may demand a restriction on the processing of your personal data when the accuracy of the data is disputed or when the processing is unlawful but a deletion is rejected by you. This right is also available to you when the data are no longer required by us but by you to assert, exercise or defend a legal claim. You may also avail yourself of this right after raising an objection to the processing of your personal data;
  • Right to data portability: You may demand that the personal data submitted to us will be forwarded to you in a structured, commonly used and machine-readable format. Alternatively, you may demand the direct transmission of the personal data supplied by you to us to another data controller when this is possible.
  • Right to lodge a complaint: You may lodge a complaint with the competent supervisory authority for data protection, e.g. when you feel that your personal data are unlawfully processed by us. The supervisory authority competent for us is:

6. Your Right to Objection

Notes on the Right of Objection as per Art. 21 GDPR

You have the right, for reasons resulting from your personal situation, to lodge an objection to the processing of your personal data performed in line with Art. 6 Subsec. 1 lit. f GDPR (Processing to Safeguard the Legitimate Interests of Data Controller or Third Party) at any time.

If you lodge an objection, we will no longer process your personal data except if we can demonstrate cogent protection-worthy reasons for the processing that override your interest, rights and freedoms, or when the processing serves to assert, exercise or defend a legal claim.

 
7. Online Data Processing

My website www.trans-sa.de also processes certain personal data, e.g. the IP address of website visitors. Hence, supplementary data protection notes can also be found online under  www.trans-sa.de/en/privacy-policy/
